Injured on the job?
For one individual it has taken 15 years to find out who was at fault for their injury.
On July 10, 2005, Mr. Cioffi, an employee of Communication Technology Services, was installing a new paging system inside of a Target store as part of a renovation project. He used a lift, owned by his company, to complete the job. After he puts away the lift, he realizes that his tool bag was still hanging from a pipe. He decided to borrow one of Target’s ladders. Once up the ladder, it shifts under him, causing him to fall and suffer several injuries.
Target denies liability and Mr. Cioffi takes them to court to get the compensation needed to take care of his injuries. The jury ruled in his favor. Then, Target moved to dismiss the complaint. The court grants the Target its request. Mr. Cioffi appealed, seeking to get rid of that dismissal.
Again, Mr. Cioffi won. The court reverses the dismissal, finding, once again, in favor of Mr. Cioffi.
